Pozůstalostní spisy se mohou stát zajímavým pramenem pro výzkum sociálních aspektů demografického vývoje, protože zachycují rodinu (domácnost) v okamžiku smrti jednoho nebo i více jeho členů. Končil tím určitý životní cyklus a začínal nový. Pozůstalostním řízením se rozhodovalo např. o nástupci hospodáře, ostatních dědicích, výši dědických podílů atd. Zisk hospodářství nebo jeho části (podílu) mohl pomoci jednotlivcům založit vlastní rodinu. Pečetní zpráva zachytila skladbu rodiny (dědiců) v okamžiku úmrtí příbuzné osoby, testament vyjádřil vůli zesnulého, pozůstalostní vyjednání stanovilo stav dědictví a jeho rozdělení. Jedná se tedy o poměrně přesnou výpověď o transferu majetku, která výrazně doplňuje informace z testamentů.

The paper focuses on the use of probate documentation in researching social aspects of demographic development, assessing the potential possibilities and limits of such sources. In the first part the author traces the shift from historical demography towards social history, based on an analysis of relevant Czech and international literature. Then there follows an assessment of legal developments in the Habsburg Monarchy and the development of inherritance law. The author subsequently analyzes the form and content of probate acts, using specific examples to demonstrate the course of the probat proceedings and to show the possibilities and (primarily) the limitations of using probate documentation as source material.
