Cet article traite des problèmes que la variation, particulièrement la variation diachronique, peut engendrer dans la traduction juridique. Lors de la traduction de textes juridiques, le traducteur fait face à des problèmes liés non seulement à l’asymétrie culturelle due au fait que tout pays possède son propre système juridique avec son système conceptuel, mais aussi à l’évolution des systèmes juridiques. Se fondant sur des exemples de termes juridiques français et tchèques, l’article propose une typologie des situations qui peuvent se produire en cas de variation diachronique de la terminologie juridique et, dans le même temps, il présente quelques stratégies de traduction auxquelles le traducteur peut recourir. Il se concentre notamment sur la variation du terme en ce qui concerne sa dénomination, engendrée par la nécessité de remplacer un terme devenu obsolète ou ne correspondant plus aux besoins de la communication contemporaine, ainsi que sur la variation portant sur son concept et qui est due principalement à l’évolution des sociétés, éventuellement sur les deux types de variation dans la perspective diachronique. Dans le même temps, cet article cherchera à montrer dans quelle mesure il est possible de refléter dans les équivalents des termes de la langue cible les changements se produisant au sein du système juridique source.

This article deals with the problems that variation, particularly diachronic variation, can cause in legal translation. When translating legal texts, the translator is faced with problems linked not only to cultural asymmetry due to the fact that each country has its own legal system with its own conceptual system, but also to the evolution of legal systems. Based on examples of French and Czech legal terms, the article sets out to establish a typology of situations that can arise in the event of diachronic variation in legal terminology and, at the same time, to present some translation strategies that the translator can apply. It focuses in particular on variation in the name of the term, caused by the need to replace a term that has become obsolete or that no longer corresponds to the needs of contemporary communication, and on variation in the concept of the term, due mainly to the evolution of societies, and possibly on both types of variation from a diachronic perspective. At the same time, the objective of the article is to show to what extent it is possible to reflect the changes occurring within the source legal system in the equivalents of terms in the target language.
